Introduction

The Environment Protection (End-of-Life Vehicles) Rules, 2025, mark a pivotal shift toward a circular economy in the automotive sector by introducing an Extended Producer Responsibility (EPR) framework. This framework transfers the accountability for waste management from the vehicle Owner to the Manufacturer and Importer, who are now legally obligated to manage the recovery and recycling of End-of-Life Vehicles (ELVs). By setting mandatory annual scrapping targets and mandating the use of Registered Vehicle Scrapping Facilities (RVSFs), the Rules ensure that materials are reused efficiently.

Procedure

1. Registration
   • Producers shall apply for registration in Form 4 on the centralized portal managed by the Central Pollution Control Board (CPCB).
   • Scrapping Facilities shall apply in Form 5 with their respective State Pollution Control Board (SPCB).
   • Bulk Consumers (Fleets of 100+ vehicles) shall file Form 6 with the SPCB.
   • The respective boards are required to issue the registration certificate within fifteen (15) days if the documents are error-free.
2. Target Declaration & Calculation
   • Producers shall submit and declare their current year’s EPR obligations to the CPCB by April 30th each year.
   • Scrapping targets are based on the weight of steel introduced in vehicles years prior.
   • The targets dictate a minimum percentage recovery of that baseline steel weight.
3. Vehicle Collection and Scrapping
   • Vehicle owners shall deposit an End-of-Life vehicle (ELV) at a Producer’s designated outlet, collection centre, or RVSF within one hundred eighty (180) days of it becoming an ELV.
   • Producers shall establish take-back systems and publish a list of their designated collection centres.
   • The RVSF processes the vehicle, safely disposes of hazardous materials, and calculates the weight of the recovered steel scrap.
4. Certificate Generation and Purchase

   Reporting & Compliance
   • The CPCB portal automatically generates one (1) kg of EPR certificate for every one (1) kg of steel scrap recorded by the facility.
   • Producers browse and purchase these valid EPR certificates on the portal to hit their targets.
   • If EPR certificates are unavailable from RVSFs, the Producer becomes directly responsible for the physical collection of vehicles.
5. Annual Returns and Compliance
   • Producers shall submit annual returns using Form 1 on the CPCB portal by June 30th for the previous financial year.
   • If a producer exceeds their target, up to thirty per cent (30%) of the EPR targets from any given year can be carried forward to offset obligations for the subsequent four (4) years.
