Procedure for Intimation of Appointment or Cessation of Receiver or Manager for Charged Property
Introduction
A person shall be appointed to manage the property of the Company, subject to a charge and such receiver or person under any power contained in any instrument give notice of appointment or cessation to the Company and the Registrar. [Section 84]
Applicable Provisions:
- Section 84 of Companies Act, 2013
- Rule 9 of Companies (Registration of Charges) Rules, 2014
Following Procedure is to be followed
File Notice of Appointment or Cessation [Section 84 and Rule 9 of the (Companies Registration of Charges) Rules, 2014]
A notice for appointment or cessation of receiver or manager who has been appointed for the charged property shall be filed in Form CHG 6 with ROC within 30 days from the date of passing of order or making such appointment or cessation. This shall be intimated to the Company as well. And on receiving the notice, ROC shall register it.
