Introduction

The growing threat of toxic waste ranging from electronic waste to harmful plastics and hazardous batteries, has raised global environmental and health concerns. Improper disposal of such waste not only depletes natural resources but also poses severe risks to ecosystems and human well-being. As a result, effective waste management has become a vital focus area for governments, organizations, and manufacturers worldwide.

One such sustainable initiative is Extended Producer Responsibility (EPR). This policy shifts the responsibility of post-consumer waste management onto the producers, ensuring that businesses actively participate in reducing their environmental footprint. It is administered by bodies such as the Central Pollution Control Board (CPCB) and State Pollution Control Boards (SPCBs), EPR requires these entities to implement systems for Collection, Recycling and Disposal of waste products which includes Waste Tyres or Used Oils in an environmentally responsible manner.

Applicable Provisions

  1. Rule 15(8) of the E-Waste (Management) Rules 2022 inserted through Rule 4 of E-Waste (Management) Amendment Rules, 2024.
  2. Schedule IX of The Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016

Mandatory Requirements

  • Registration of producers, importers or recyclers with SCPBs or CPCB.

Procedure

  1. Online Registration- Producers, Importers or Brand Owners shall initiate registration via the official portal of the Ministry of Environment, Forest and Climate Change (MoEFCC) or through the CPCB/SPCB platforms, depending on the category of waste (e.g., e-waste, plastic waste, battery waste).
  2. Submission of Product Details- Applicants are required to submit comprehensive product data, including:
    • Type of product manufactured or imported
    • Material composition
    • Packaging specifications
    • Estimated volume of waste generated
  3. Waste Management Plan- An effective waste management plan shall be uploaded, detailing:
    • Collection methods
    • Recycling mechanisms
    • Disposal systems
    • Annual recycling or recovery targets

EPR Certificate Renewal- EPR authorization is typically valid for a specified period (varies by waste type, such as 120 days before expiry for e-waste).

  1. Application Submission: File for renewal through the relevant authority’s online portal at least 120 days before certificate expiry.
  2. Document Upload: Submit updated waste management records, compliance reports and revised targets, if any.
  3. Fee Payment: Pay the applicable renewal fee as specified by the authority.
  4. Inspection (if required): Authorities may conduct audits or inspections before approval.
  5. Certificate Issuance: Upon successful verification, a renewed EPR certificate is issued for continued operations.

All transactions shall be recorded and submitted by the producers or recyclers on the portal at the time of filing quarterly returns.
