Introduction

The Environment Protection (End-of-Life Vehicles) Rules, 2025, framed under the Environment (Protection) Act, aim to create a structured system for safe and environmentally sound scrapping of old vehicles in India. Within this regulatory framework, a structured system has been created for Registration, suspension and cancellation.

Who can Register Under ELV Rules, 2025

  • Producers
  • Owners
  • Bulk Consumers
  • Registered Scraping Facilities

Applicability Provisions

  • Sections 3, 6, 8 of the Environment (Protection) Act, 1986
  • Rule 5 of Environment (Protection) Rules, 1986

Essential Requirements

  • Form 4 by the Producer for registration with the Central Board
  • Form 5 by the Registered Vehicle Scrapping Facility for registration, to the State Board
  • Form 6 by Bulk Consumer for registration, to the State Board

Procedures

  1. Application for Registration
    • A Producer shall apply for registration with the Central Board using Form 4.
    • Registered Vehicle Scrapping Facility shall apply using Form 5 to the State Board.
    • Bulk Consumer shall apply using Form 6 to the State Board.
    • All stakeholders shall register on the Centralised Online Portal
  2. Grant of Registration
    • Upon receiving the application, the Central Board or State Board shall process it and, if satisfied, grant registration.
    • The registration certificate shall be issued by the Authority within fifteen (15) days:
      • Producers: Form 7
      • Registered Vehicle Scrapping Facilities and Bulk Consumers: Form 8
  3. Validity of Registration
    The registration certificate shall be valid unless it is suspended or cancelled under these rules.
  4. Suspension or Cancellation (Producer)
    • The Central Board may suspend or cancel a Producer’s registration for violation or non-compliance with the rules.
    • This action shall be taken only after giving the Producer an opportunity to be heard.
  5. Disposal of Producer’s Appeal
    • The Central Government may authorise an officer (not below the rank of Joint Secretary) to hear and decide the appeal.
    • The appeal must be disposed of within forty-five (45) days of receipt.
  6. Suspension or Cancellation (Facility / Bulk Consumer)
    The State Board may suspend or cancel the registration of a Registered Vehicle Scrapping Facility or bulk consumer for violations or non-compliance only after providing an opportunity to be heard.
