Introduction

General Authorization for Export of Chemicals and Related Equipment (GAEC) permits the export/re-export of specific Special Chemicals, Organisms, Materials, Equipment, and Technologies (SCOMET) items-specifically Categories 1C, 1D, 1E, 3D001, and 3D004-to designated countries and recipients without requiring individual, case-by-case licenses for each shipment to countries enumerated in Appendix 10(N). The detailed framework for such authorization is specified under Foreign Trade Policy, 2023 read with Handbook of Procedures, 2023.

Mandatory Requirements

  • Valid Importer-Exporter Code (IEC)
  • Declaration that items intended to be exported shall not be used for any purpose, is to be given.

↓↓ Procedure to be Followed (Step-By-Step) ↓↓

  1. Obtain Importer-Exporter Code:
    Importer/ Exporter shall obtain valid Importer-Exporter Code (IEC) in case they do not already possess the same. (Please refer Article on Import-Exporter Code – https://www.lawrbit.com/article/importer-exporter-code/, information for detailed)

    Note: If IEC is in DEL, authorization request can still be submitted, but it will be processed only, after the IEC is removed from DEL.

  2. Initial Identification of SCOMET Category for GAEC:
    Identify SCOMET category and ensure item and destination are covered under GAEC.
  3. Application for Grant of Authorisation:
    Exporter shall file an application in Form ANF-10A through online SCOMET portal along with self-certified copies of the following documents:
    • Purchase Order from the Foreign Buyer, Consignee and End–User
    • End User Certificate(s) i.e., formal declaration verifying the final application and destination of goods or
    • Technical Specifications for the items to be exported
    • Bills of Entry (BEs) into the destination country for items exported during the last one year
    • Bills of Entry (BEs) with first application of the financial year only and from second application onwards, the exporter shall make are reference in the forwarding letter, that it has been submitted with first application
    • If a third party or contractor is involved, details of Contract or Agreement between the Foreign Buyer and End User with third party must be submitted, along with copy of contract or agreement
    • Category of the items proposed to be exported as per Appendix3 of ITC (HS) Classifications of Export and Import Items
    • Declaration on Letter Head duly signed and stamped stating that export shall only be done for civilian end use
  4. Issuance and Validity:
    • Inter-Ministerial Working Group (IMWG), will review and examine the export authorisation request
    • SCOMET Cell in DGFT shall issue the export Authorisation, upon the receipt of Inter-Ministerial Working Group (IMWG) approval
    • Authorisation so granted shall be valid for a period of 5-year.
  5. Post Authorization Obligation:
    • Prior to exporting with a GAEC authorisation, the applicant exporter must ensure:
      • Shipment related details, are notified, to the relevant government authorities, within 30 days of export, in Form ANF 10A along with EUC in prescribed format and c opy of the bill of entry, into the destination country
      • Have an agreement or a purchase order, excerpt of contract from entity receiving the items which states that the export is for a permitted use an end use as declared in the EUC before actual export
      • Documents including the name, contact number and email id of the authority signing the EUC before actual export, are in their possession
      • Any subsequent transfer/export/re-export under GAEC, to the list of applicable countries, is only for civilian end use, and declaration to that effect is submitted on their letter head
    • Post-shipment details of each export/ re-export of SCOMET items under the specified Categories or sub-categories under GAEC, are to be submitted, within 30 days of export.
    • All the relevant records, including documents submitted while making an application for SCOMET Authorisation, in manual or electronic form, are required to maintained, for a period of 5 years or till validity of export authorisation, whichever is higher.

Note: GAEC would not be issued:

  • In case of items to be used to design, develop, acquire, manufacture, possess, transport, transfer and / or used for chemical, biological, nuclear weapons or for missiles capable of delivering weapons of mass destruction and their delivery system
  • For countries or entities covered under UNSC embargo or sanctions list or on assessment of proliferation concerns, or national security and foreign policy considerations, etc.
