Procedure for SCOMET Items export Authorisation

Introduction

SCOMET stands for Special Chemicals, Organisms, Materials, Equipment and Technologies, which are broadly categorized as under:

  • Category 1: Micro-organisms, Toxins
  • Category 2: Toxic chemical agents and other chemicals
  • Category 3: Materials, Materials Processing Equipment and related Technologies
  • Category 4: Nuclear-related other equipment and technology (not controlled under Category ‘0’)
  • Category 5: Aerospace systems, equipment, and related Technology
  • Category 8: Special Materials and Related Equipment, Electronics, Computers, Sensors and Lasers, etc.

The detailed list of such items (category-wise) is specified in Table (SCOMET Categories). Policy relating to general provisions governing the export of dual use items, munitions and nuclear related items, including software and technology, viz. SCOMET, is specified in Chapter 10 of FTP.

APPLICABLE PROVISIONS

  • Para 10.01, 10.02, 10.03, and 10.04 of Foreign Trade Policy (FTP), 2023.
  • Para 10.00, 10.04, and 10.06, 10.20 of Handbook of Procedures (HBP), 2023.

MANDATORY REQUIREMENTS

  1. Valid Importer-Exporter Code (IEC)
  2. Valid DSC must be registered in the system
  3. Mandatory submission along with application:
    • End-User Certificate (EUC) i.e., formal declaration verifying the final application and destination of goods or
    • Legal Undertaking (LU) i.e., Binding agreement ensuring compliance with export obligations and policy stipulations
  4. Classification of Import and Export Items should be as per Appendix 3 (List of SCOMET Items).

PROCEDURE TO BE FOLLOWED (STEP-BY-STEP)

  1. Obtain Importer-Exporter Code:

    Importer/ Exporter shall obtain valid Importer-Exporter Code (IEC) in case they do not already possess the same.

    Note: If IEC is in DEL, authorization request can still be submitted, but it will be processed only, after the IEC is removed from DEL.

  2. Application for Grant of Authorisation:

    Exporter shall file an online application in Form ANF 10A, along with registration fee of Rs. 1000, via the official DGFT website (https://www.dgft.gov.in/CP/) under the path Services 🠊 Export Management System 🠊 SCOMET for the following purposes:

    • Export Authorisation for SCOMET items as specified in Appendix 3 (List of SCOMET Items), including software and technologies (Appendix 3 to Schedule 2 of ITC (HS))
    • Export or transfer of such items regulated under Catch-all Controls
    • Authorisation for repeat orders (excluding Category 3A001 and software/technology under any category), for the export of same SCOMET items, to the same country/ entities
    • For repair or replacement of imported item(s) abroad and return of indigenous SCOMET items, return of items imported for repair in India, and Authorisation for export of SCOMET items after repair in India (GAER)
    • Authorisation for:
      • Export of indigenous/ imported SCOMET item(s), for demo/ display/ exhibition/ tenders/ RFP/ RFQ/ NIT purposes abroad
      • Export of SCOMET item(s) imported, for participation in demo/ display/ exhibition/ tenders/ RFP/ RFQ/ NIT in India
  3. General Authorisation for Export of Chemicals and related equipment (GAEC).

Note:

  1. GAEC parameters and requirements specified in the table below:
    Parameter Specific Requirements
    Product Scope & SCOMET Classification Covers export/re-export of Chemicals (excl. Software/Technology). Applies to SCOMET Categories/Sub-Categories: 1C, 1D, 1E, 3D001, and 3D004
    Geographic Jurisdiction Applicable to countries listed in Appendix 10N. For countries not listed, a specific destination list must be provided for evaluation
    Authorisation Validity Issued with a one-time validity of 5 years for all export operations conducted under the GAEC.
    Eligibility Enhancements Submission of Authorised Economic Operator (AEO) or Status Holder Certificate may be provided for suitable consideration.
    ITC (HS) Classification (ANF 10A) Mandatory declaration of item categories as per Appendix 3 of ITC (HS) Classifications of Export and Import Items.
    Logistics and Transport Protocol Port of discharge and route must be predefined. Modification of route or mode of transport is prohibited post-issuance of the license.
  2. Copy of an existing SCOMET application can be created, using pathway :
    My Dashboard ⮚ Submitted Applications ⮚ Select Type of Scheme from dropdown ⮚ Type of Sub Scheme ⮚ Search and Click on Make a Copy.
  3. Issuance and Validity:
    • Inter-Ministerial Working Group (IMWG), will review and examine the export authorisation request
    • SCOMET Cell in DGFT shall issue the export Authorisation, upon the receipt of Inter-Ministerial Working Group (IMWG) approval
    • Authorisation so granted shall be valid for a period of 24 months (unless specified otherwise, such as the 5-year GAEC).

    Note:

    • Authorizations granted are non-transferable.
    • Approved Authorisation for SCOMET, can be found using the pathway:

  4. Revalidation of SCOMET Authorisation:
    Export Authorisation for SCOMET items may be revalidated, on merits for a period of 6 months at a time and maximum upto 12 months, by the DGFT (Hqrs). Application for grant of revalidation may be made in Form ANF 10F, 30 days, prior to the expiry of authorization, along with a fees of Rs. 500.

    Note:

    • Renewal Period of authorisation shall be counted from the actual expiry date of authorisation.
    • The total period of extension will not exceed 12 months.
    • Revalidation to export authorisations issued for Technology or Software transfer under any category is not permitted.
    • SCOMET Authorisations issued under GAEC, GAICT, GAER, GAEIS, GAET, GAED policy cannot be revalidated.
