Procedure for Issuing Duplicate Copies of Authorisation under FTP

Introduction

Directorate General of Foreign Trade (DGFT) may issue a duplicate copy, of any Authorisation or permissions or License or Certificate issued under Foreign Trade Policy, upon a request made by the applicant, where a physical copy is lost or misplaced. Detailed provisions for making such request are covered under Handbook of Procedures (HBP), 2023.

Applicable Provisions

  • Para 2.23, 2.24, 2.25, 2.26 and 2.27 of Handbook of Procedures (HBP), 2023.

Mandatory Requirements

  1. Self-Declaration for obtaining duplicate copy of freely transferable Licenses/ Authorisation, must clearly specify:
    • Document is lost/ misplaced
    • Whether utilized or not
    • Undertaking to return original if found
  2. Mandatory documents to be submitted, with the request for a duplicate copy:
    • Fee equal to 10% of duty saved or remaining duty credit
    • Copy of FIR reporting loss
    • Self- declaration indemnifying any potential revenue loss, due to issuance of such duplicate copy.

Procedure for Issuing Duplicate DGFT Authorisations

  1. Submit Request for Duplicate Copy:
    Applicant must submit an application/ request in Appendix 2M, to concerned office, where the original license was issued, along with the following:
    • Fee equal to 10% of duty saved or remaining duty credit
    • Copy of FIR reporting loss
    • Self- declaration indemnifying any potential revenue loss, due to issuance of such duplicate copy.
  2. Issuance and Validity:
    Regional Authority (RA) shall:
    • Examine the application submitted, by the applicant
    • Cancel the original license
    • Obtain a utilization report of the Authorisation, from Custom Authority, at port of registration, before issuing duplicate, for the remaining unutilized balance
    • Issue a duplicate copy of the Authorisation.

Note

  • Duplicate Authorisation will remain valid only for the same period as the original period, and no request will be considered, after the expiry of the original validity.
  • If an Authorisation is lost by a Government agency and a proof to this effect is submitted, documents as specified above are not required and revalidation will be granted for 06 months, from date of endorsement.
